Expert Witness Services for Personal Injury Solicitors

When solicitors are acting on behalf on seriously injured clients, it is essential that all future needs and associated costs are identified and properly evidenced.

Our specialist expert witness service helps personal injury solicitors quantify future Court of Protection, health and welfare, community care and education-related costs, ensuring claims are accurately valued and supported by robust expert evidence.

Why expert evidence matters

Many seriously injured clients face lifelong challenges that extend far beyond their immediate medical needs.

The costs associated with these future needs can be substantial, often amounting to hundreds of thousands of pounds over a client’s lifetime. When properly evidenced, these costs can be the subject of a head of claim within the personal injury claim for damages.

For clients with impaired mental capacity or Special Educational Needs (SEN) as a result of their injuries, these future costs might include:

However, these heads of claims are sometimes overlooked, resulting in undervaluation of the claim. This can lead to difficulties which may prejudice the client and their court-appointed deputy in the future.

Our expert witness support helps personal injury solicitors identify, explain and quantify these future costs with confidence.

How an expert witness can help

We use our expertise as a national department with expertise in Court of Protection health and welfare matters, education law and community care law to act as experts pursuant to CPR part 35 in personal injury claims.

We frequently prepare such reports which:

  1. Set out clearly and succinctly the aspects of the client’s circumstances which are relevant to either future health and welfare costs or education law costs
  2. Analyse those circumstances within the relevant legal framework and up to date case law to provide likely future costings to be claimed by way of damages, providing a robust evidence base for the same
  3. Set out clearly the likely future costs which can then be claimed within the Schedule of Loss.

Our support doesn’t end with the production of the report. We are happy to:

  • Attend conferences with counsel and other experts instructed
  • Undertake discussions with defendants’ experts
  • Prepare detailed joint statements for use in the personal injury claim
  • Be available on the day of the joint settlement meeting to provide further insight and support where required
  • Attend Trial to give oral evidence to assist the court, when required.
