What is probate conveyancing?

As an executor or administrator, you make sure the legal affairs, taxes, and admin of a person who’s died are in order, and their property can be sold or passed over to the people inheriting it. 

What does probate conveyancing involve?

If the person who’s died owned a home, you’ll need to get it valued (usually by three different valuers or estate agents for accuracy and fairness).

To sell their home, you’ll need to be named on the Grant of Probate (we can help you apply). To transfer their home (let someone else move in), you’ll need a Deed of Assent. You’ll need to make sure the property is registered with the Land Registry before either can take place.

As an executor, you’ll need to include specific clauses in the transfer to protect yourself as the estate’s representative. And it’s your duty to make sure any beneficiaries (heirs) get as much money as possible out of the sale.

It’s a big job, and it can get complicated if beneficiaries argue against the will. Going into the process with legal help on your side can make a world of difference.
