What is a Protective Award?

A Protective Award is awarded by an Employment Tribunal when an employer fails to meet their legal obligation regarding collective consultation.

An employer is obliged to collectively consult with employees where they plan to make 20 or more employees redundant, within a 90-day period.

In cases where an employer becomes insolvent, it’s usually not possible for a consultation process to take place.
